New DUI defense?

John Przybla a Wisconsin man blames beer-battered fish for the strong odor of alcohol on his breath, after getting pulled over for making a U turn on highway 13. The 75-year-old had previously been pulled over 9 times for DUI and was currently driving on a Suspended License.  “At the hospital he told me it was against his religion to give the blood draw,” said the arresting officer deputy Lowenhagen. The deputy eventually got a search warrant and the blood test found a blood alcohol level of .042. “It’s really a very serious offense,” said Lowenhagen. “We’re lucky that he didn’t injure or kill somebody that day.
