Reinstating Your Driver’s License After a DUI Arrest

If you were arrested for DUI and you either blew .08 or above or your refused the breath test, your license has been suspended and you have 10 days to either reinstate your license or challenge the suspension. (DMSMV Administrative Options PDF).

Driver’s License Suspension Time Lengths After a DUI Arrest

  • For 6 months if you blew above a .08
  • For 12 months if you blew above .08 and previously blew above .08
  • For 12 months if your refused to take the breath test
  • For 18 months for a second or subsequent suspension for refusal to take a breath test

An entry has been entered on your Florida Driving History for Driving With an Unlawful Blood Alcohol Level or Refusal to Submit to Breath Test. The entry will remain on your Driving History unless you elect Option B below and win your formal review hearing. You face mandatory hard time (a period of no driving whatsoever) if you lose your formal review hearing. Selecting Option A below allows you to immediately reinstate your license for business purposes only.

Option A Elect to Waive the Formal Review Hearing

  • If eligible, you can file a Request for Eligibility Review Form and if approved you will receive a hardship license for the full length of your suspension and you will not have the threat of going 30-90 days without any driving privileges
  • Must have no prior DUI convictions and no prior DUI administrative suspensions
  • Must sign up for DUI school
  • Must take DUI school enrollment form, DUI citation, and $25 eligibility review hearing fee to a Bureau of Administrative Review (BAR) office. The BAR office locations are written on the back of your DUI citation.
  • Must then pay approximately $175 for an administrative reinstatement fee and $25 for the issuance of your business purposes only license
  • You have only 10 days do to all of the above. Failure to start and finish this process within 1o days will result in mandatory hard time of at lease 30 days

Option B Elect to Have a Formal Review Hearing

  • Must be within first 10 calendar days after receiving DUI Citation
  • Pay $25 formal review hearing fee
  • If eligible, you will receive 42-day temporary driving permit for business purposes only
  • A Formal Review Hearing will be set within 30 days, where at your expense we can subpoena and question witnesses associated with your case

If we win your Formal Review Hearing, your administrative suspension will be removed and your license will be reinstated. If we lose the hearing, you will face hard time and go a period of time with no driving whatsoever:

  • 30 days with no driving if you blew .08 or above, may apply for hardship license after 30 days
  • 90 days with no driving if you refused the breath test for the first time, may apply for a hardship license after 90 days
  • 18 months with no driving whatsoever for a second or subsequent refusal, not eligible for a hardship license so 18 months suspension is all hard time
