The Seminole County State Attorney’s Office has created a program called the First time DUI Offender Program. Successful completion of the first time DUI offender program will result in your DUI charges being reduced to reckless driving. You will maintain a withhold of adjudication. All cases are evaluated on an individual, fact- specific basis. A defendants eligibility is determined by DUI filing division. If approved for the program, you must complete three pre-conditions within 60 days of approval. The three conditions are:
- Proof of $400 contribution to Kid’s House of Seminole County
- Proof of enrollment or completion of the DUI school
- Proof of enrollment or completion of the Victim Awareness Program or YouImpact online course
Requirements for the First Time DUI Offender Program
The first time DUI offender program is available to those who have been recently arrested for a DUI in Seminole County. Individuals must also meet the following requirements:
- Blood Alcohol concentration (B.A.C) below .2500
- No accident was caused by the DUI
- No minor children present
- No prior DUI’s or similar offenses
- Have not previously served prison time
- Driver’s license was valid at the time of the arrest
- No cases where there is additional charges at the time of the arrest (Resisting, cannabis, Etc.)
A look inside the program: Tier 1 and Tier 2
There are two different tiers for the program, tier 1 and tier 2 depending on the facts of your case. If approved for tier 1, you will plea to reckless driving (alcohol related)- adjudication withheld and be placed on probation for a period of six months.
Conditions of probation include:
- $100 fine, standard court costs, costs of prosecution and cost of investigation
- $400 donation to the Kids House of Seminole County
- Proof of successful completion of DUI School
- Successful completion of any DUI school recommended alcohol/substance abuse treatment
- Successful completion of twenty (20) total community service hours at approved location(s)
- Proof of successful completion of the Victim Awareness Panel or YouImpact
online course (www.youimpact.com) - No possession or consumption of alcohol/illegal drugs/non-prescribed drugs during probation
- Random alcohol/drug testing conducted by probation at Defendant’s expense
If selected for tier 2 you will you will plea to reckless driving (alcohol related)- adjudication withheld and be placed on probation for a period of nine months
Conditions of probation include:

- Immobilization of Defendant’s vehicle for ten (10) days
