ORANGE COUNTY DRUG DIVERSION POLICY
The Orange County State attorneys office has approved three different drug diversion programs. All three programs allow a client, defendant or person to get his or her charges competently dismissed. Level two is the most common drug diversion program.
WHAT IS THE LEVEL TWO PROGRAM?
The level two program is the name for the pretrial diversion program in Orange county, Florida for persons charged with simple possession of a controlled substance, including possession of felony cannabis, cocaine, heroin, fentanyl among others. Eligible charges also include possession of cannabis with the intent to sell.
WHAT CHARGES ARE ELIGIBLE FOR LEVEL TWO
Eligible charges include:
- Felony Possession of Cannabis
- Possession of Cocaine
- Possession of Controlled Substance
- Possession of Fentanyl (and other controlled substances)
- Possession of Cannabis with the Intent to Sell
LEVEL TWO ELIGIBILITY
Participants must be charged with a low level, non-violent drug offense and must not have participated in any drug diversion program in the past 6 months.
LEVEL TWO PROGRAM REQUIREMENTS
The level two requirements are fairly easy and can be literally completed in a single day. Once formally approved for the level two program, participants must:
- Complete an in person drug evaluation or a four hour online substance abuse class
- Complete four hours of community service
- Pay $100 for the cost of prosecution, plus any cost of investigation
- Don’t violate the law or get arrested anytime from the beginning of the program, to 175 after the end of the program
CAN I EXPUNGE MY RECORD?
In a word, YES. You can seal or expunge your record when you successfully complete the Level II Drug Diversion Program as long as you are previously eligible to do so. That means no prior Florida criminal convictions or prior sealing or expugements. Expungement is a great way to remove your arrest record, court file, police report, and other case information from public record.
