Misdemeanor Diversion For A First Time Arrest

Orange County misdemeanor pretrial diversion (PTD) is a deferred prosecution program for selected misdemeanor cases. The programs are offered by the State Attorney’s Office and supervised by the Orange County Community Corrections Department. Successful completion of pretrial diversion will result in the dismissal of the case by the State Attorney’s Office.

Orange County Misdemeanor Diversion Requirements

There are several categories of Orange County misdemeanor pretrial diversion: general diversion, drug or domestic violence diversion and DUI diversion.

General Misdemeanor Pretrial Diversion

General misdemeanor diversion are is for charges not related to drugs, traffic or domestic violence charges. These offenses include simple battery, criminal mischief, disorderly conduct, disorderly intoxication, resisting an officer without violence, soliciting a prostitute and trespassing. The program length is 6 months and the program cost is $300. Special conditions of general misdemeanor diversion can include community service, educational classes, restitution and a state attorney’s office fee.

Misdemeanor Drug Diversion

Misdemeanor drug charges (possession of cannabis, possession of drug paraphernalia) are referred to a 12 month diversion program with a program cost of $600. All drug cases include the additional special condition of random drug testing, a drug evaluation and counseling if recommended.

Misdemeanor Domestic Violence Diversion

Domestic violence cases referred to pretrial diversion will include the additional requirement of attending and completing a 26 week batterer’s intervention program. No contract or no-hostile contact may also be ordered.
